These terms govern your purchase and use of AVIONICS, a suite of technical-analysis indicators for the TradingView platform, operated by Avionics Deck (“we”, “us”). By purchasing or using AVIONICS you agree to them. If you do not agree, do not purchase or use the product.

1 · What AVIONICS is, and what it is not

AVIONICS is a charting and analysis tool. It calculates and displays indicators on price data you already have access to through TradingView.

AVIONICS is not financial, investment, tax or legal advice. It is not a recommendation to buy or sell any security, contract or other instrument, and it is not a managed product, signal service or discretionary advisory service. We are not a licensed broker, investment adviser or financial planner, and nothing in the product or on our website creates an advisory or fiduciary relationship between us.

Every trading decision you make is yours alone. You are solely responsible for your own research, risk management and outcomes.

2 · Licence

Subject to payment and to these terms, we grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to use AVIONICS on one TradingView account, for your own use, for the duration of your access.

You may not

• share, lend, sell, rent, sublicense or transfer your access, or allow any other person to use it, including through a shared or group TradingView account;
• redistribute, republish, mirror or resell AVIONICS or any part of it;
• attempt to decompile, reconstruct, extract or otherwise obtain the source code of any AVIONICS script;
• create or distribute derivative works based on AVIONICS;
• use AVIONICS to operate a competing signal service, or to sell signals derived from it;
• remove, obscure or alter any branding, notice or disclaimer contained in the product.

We retain all intellectual property rights in AVIONICS. Nothing here transfers ownership. If you breach this section, we may terminate your access immediately and without refund.

3 · Delivery and access

AVIONICS is delivered as invite-only scripts on TradingView. No files are downloaded and no source code is provided. After purchase you supply your TradingView username and we authorise that username to use the scripts.

• You must have your own TradingView account. Certain TradingView features used by the product, such as server-side alerts, may require a paid TradingView plan. That plan is your responsibility and is not included in the price of AVIONICS.
• Supplying an incorrect username may delay access. We are not responsible for delays caused by incorrect details.
• Access is normally granted promptly, but is not guaranteed to be instantaneous.

4 · Dependence on TradingView

AVIONICS runs on TradingView, a third-party platform we neither own nor control. TradingView sets its own rules, pricing, availability and technical limits, and may change them at any time. We are not responsible for interruptions, changes, restrictions, outages or account actions arising from TradingView, and such events do not on their own entitle you to a refund beyond the refund period in section 6. If TradingView ceases to permit invite-only script distribution, section 5 governs what happens next.

5 · Plans, billing and what “lifetime” means

Pilot — monthly subscription

Billed monthly in advance and renews automatically until cancelled. You may cancel at any time; cancellation stops future billing and access continues until the end of the period you have already paid for. Access ends when the paid period ends. We may change subscription pricing on notice; changes apply to renewals after the notice period, never retroactively.

Command — one-time payment

“Lifetime” means the operational life of the product, not the lifetime of any person. Command access continues for as long as AVIONICS is commercially offered and maintained by us, and includes updates and any new instruments we add to the suite during that period.

If we permanently discontinue AVIONICS, we will give Command holders at least 90 days’ notice by email to the address on file, and access continues throughout that notice period. We will not discontinue the product for the purpose of avoiding existing Command access, nor to re-release the same product under a new name to the same market.

Command access remains subject to sections 2 and 4: it can be terminated for breach of the licence, and it cannot outlive the TradingView platform on which the product depends.

6 · Refunds

All sales are final. We do not offer refunds on either plan. Evaluate the product using the material on our website before purchasing; if you are unsure, choose the monthly plan rather than the one-time payment.

• Cancelling a subscription stops all future billing; access continues to the end of the period already paid for. You are never charged for time you did not choose.
• By purchasing, you request immediate delivery of access and acknowledge that, where permitted by law, any statutory withdrawal right lapses once access is granted.
• Nothing in this section limits any refund or cancellation right that the consumer law applying to you makes mandatory. Where such a right exists, it is unaffected.

7 · Performance figures and hypothetical results

All performance figures shown by AVIONICS or on our website are hypothetical backtests generated from historical data. They are calculated from the engine’s own signals, entered and exited at bar close, compounded, and unless stated otherwise they exclude slippage, commissions, financing costs, taxes and the effect of real capital at risk.

Hypothetical results have inherent limitations. They are prepared with the benefit of hindsight, no real money was placed at risk, and they cannot account for the effect of real market conditions or of a trader’s own decisions. Past performance is not indicative of future results. No representation is made that any account will or is likely to achieve results similar to those shown.

8 · Risk

Trading involves substantial risk of loss and is not suitable for every investor. You can lose some or all of your capital, and in leveraged products you can lose more than your initial deposit. Do not trade with money you cannot afford to lose. Consider seeking advice from a licensed financial adviser before making any investment decision.

9 · No warranty

AVIONICS is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the product will be uninterrupted, error-free, or that its calculations, signals or alerts will be accurate, timely or delivered at all.

10 · Limitation of liability

To the fullest extent permitted by law, we are not liable for any trading losses, lost profits, lost opportunities, loss of data, or any indirect, incidental, special, consequential or punitive damages arising from your use of, or inability to use, AVIONICS — including where a signal, alert or figure is delayed, missed, incorrect or misinterpreted.

Our total aggregate liability arising out of or relating to these terms or the product is limited to the amount you actually paid us in the twelve months preceding the event giving rise to the claim.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or for death or personal injury caused by negligence.

11 · Indemnity

You agree to indemnify and hold us harmless from any claim, loss or expense arising from your use of AVIONICS, your breach of these terms, or your violation of any law or third-party right.

12 · Suspension and termination

We may suspend or terminate your access immediately if you breach these terms, if payment fails or is reversed, or if we are required to do so by law or by TradingView. You may stop using the product at any time. Sections 1, 2 (restrictions), 7–11 and 14 survive termination.

13 · Changes to these terms

We may update these terms. Material changes will be notified by email to the address on file or by a notice on the website before they take effect. Continued use after the effective date means you accept the updated terms. The “last updated” date above always reflects the current version.

14 · Governing law

These terms are governed by the laws of [JURISDICTION — placeholder], and the courts of [JURISDICTION — placeholder] have exclusive jurisdiction, without prejudice to any mandatory consumer protections available to you where you live.
